    These Terms of Service (“Terms”) govern your access to and use of the services provided by Askube (“we”, “our”, or “us”), including the website getaskube.com and the Askube Chrome Extension (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

    1. Eligibility

    You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

    2. Description of Service

    Askube is a YouTube content tool that allows users to analyze publicly available YouTube videos, chat with video transcripts, and generate derivative content including social media posts, flashcards, study guides, presentation slides, and transcripts. The Service requires a Google account for authentication and optionally integrates with Notion for content export.

    We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

    3. Accounts and Authentication

    You sign in to the Service using your Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Askube account. You agree to notify us immediately at prithvi@getaskube.com of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

    4. Acceptable Use

    You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

    • Submit videos that contain or are used to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
    • Use the Service to infringe the intellectual property rights of any third party, including the copyright in YouTube videos.
    • Attempt to circumvent, disable, or interfere with any security feature, rate limit, or access control of the Service.
    • Use automated scripts, bots, or other means to access the Service in a way that exceeds normal human use or circumvents usage limits.
    • Reverse engineer, decompile, or disassemble any part of the Service.
    • Resell, sublicense, or commercially exploit the Service or content generated by it without our prior written consent.
    • Misrepresent your identity or impersonate any person or entity.

    5. Credits, Plans, and Payments

    The Service operates on a credit-based model. Free accounts receive a limited number of credits per month. Paid plans provide additional credits and capabilities. All paid plans are subject to the following terms:

    • Payments are processed by Razorpay. By making a payment, you agree to Razorpay's terms of service.
    • Subscription credits reset on a monthly basis and do not roll over. Starter pack (one-time purchase) credits do not expire.
    • All purchases are final. We do not offer refunds unless required by applicable law or at our sole discretion in exceptional circumstances.
    • We reserve the right to change plan pricing with reasonable advance notice. Price changes will not apply to your current billing period.

    6. Intellectual Property

    Our IP: The Service, including its software, design, branding, and documentation, is owned by Askube and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

    Your content: You retain all rights to the YouTube URLs you submit and the output you generate. By using the Service, you grant us a limited, non-exclusive license to process your inputs and produce outputs solely for the purpose of delivering the Service to you.

    Third-party content: YouTube videos and their transcripts are owned by their respective creators. Content generated by Askube is derived from those videos. You are solely responsible for ensuring your use of generated content complies with applicable copyright law and YouTube's Terms of Service.

    7. Disclaimers

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. CONTENT GENERATED BY THE SERVICE IS BASED ON AI MODELS AND PUBLIC VIDEO TRANSCRIPTS AND MAY CONTAIN ERRORS, INACCURACIES, OR OMISSIONS. YOU USE THE SERVICE AND ANY GENERATED CONTENT AT YOUR OWN RISK.

    8. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASKUBE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $10.

    9. Indemnification

    You agree to indemnify, defend, and hold harmless Askube and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

    10. Termination

    We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time by contacting us at prithvi@getaskube.com. Unused credits are non-refundable upon termination.

    11. Third-Party Services and Links

    The Service integrates with third-party services including Google, Notion, Razorpay, and YouTube. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.

    12. Governing Law and Disputes

    These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in India.

    13. Changes to These Terms

    We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.

    14. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Askube regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
